Governing law and Jurisdiction

The State or Federal Courts located in Vic will have the exclusive jurisdiction to hear and determine any claims or disputes arising out of or relating to these terms and conditions.

Release

To the full extent permitted by law, the participants (of any and all elective outdoor activities provided by third party providers) releases and discharges the Samudra Creative Consulting representatives from any and all liability for loss, claims, demand, damage, injury or expense,that the participant their representatives, participants and invitees suffer as a result of participation in the activity and/or attendance in outdoor and indoor environments, due to any cause whatsoever, including negligence.

Medication, Illness and First Aid

Samudra Creative Consulting reserves the right to assume that third party providers will apply additional conditions to bookings where participants have specific medical or special needs and where in its opinion, this may impact on a person’s safe participation in the activity and also reserves the right not to accept a booking in this situation.

By booking, the participant warrants that the participants are in good health and proper physical condition to safely participate in the activity and have no known physical or mental conditions that would adversely affect the participant’s ability to safely participate in the activity.

The participant gives Samudra Creative Consulting and the third-party providers staff leading

the activity permission to seek emergency medical services for the participant, should he or she become ill or injured, and agrees to pay the costs of those services.

Disclaimer

The participant acknowledges outdoor activities such as surfing, canoeing, SUP, paddleboarding, bush walking and activities of a physical nature can be dangerous and can pose a risk. On purchase and booking of all activities from Samudra Creative Consulting, the participant accepts full responsibility for their conduct and personal safety and agrees to have voluntarily chosen to participate in the activity.

The participant and their representatives understand it may involve physical activity of a strenuous nature, and that there are inherent risks in all aspects of physical activity, including injury and death. The participants knowingly assume all the inherent risks of the activity and waive all claims the participant, agents, suppliers and representatives may have against

Samudra Creative Consulting and its representatives, instructors.

Variations and cancellations

1. All cancellations to bookings must be made by email.

2. Samudra Creative Consulting, at its absolute discretion, may cancel a booking at anytime. If a booking is cancelled, the participant will be notified by phone or email in accordance with the contact details provided in the booking form and will be provided with a full refund of the fees paid or a credit for an alternative booking date.

Changes and Cancellations

Once the booking is confirmed, changes by the participant will only be accepted if received by email at least three days before the date of the activity and no refunds will be given for on the day cancellations or changes made within 24 hours of the date of the activity.

Unaccompanied Minors

All guests under the age of eighteen (18) must be accompanied by a responsible adult. If a participant is found to be a person under the age of (eighteen) 18 who is not accompanied by a responsible adult, Samudra Creative Consulting third-party provider may immediately cancel the participants booking and the full booking amount will be forfeited.
